Please read this Notice carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our terms, your choice is not to use our Services. By accessing or using this Website, you agree to this Privacy Notice. This Notice may change from time to time (see Changes to Our Privacy Notice). CHILDREN’S PRIVACY The Services are general audience and intended for users thirteen (13) and older. We do not knowingly collect Personal Information directly from anyone younger than age 13. Clients: As described in the following section, we may collect Personal Information about children from parents and/or guardians who voluntarily provide such information for the provision of our Services. By providing Personal Information of or on behalf of your child, you consent to our use of your child’s Personal Information in accordance with this Privacy Notice. If you become aware that your child under 13 years of age has filled out our questionnaire, created an account or otherwise posted personal information through the Services, please notify us at support@eczemagrouphug.com so that we can take appropriate action. We may require verification of your identity. WHAT PERSONAL INFORMATION WE COLLECT, HOW WE COLLECT IT, AND WHAT WE USE IT FOR. We collect several types of information from you and about users of our Services, such as basic contact information when you sign up for an account (“Account”). Other types of information we collect is information related to how you use our platform, which helps us improve our Services. Depending on the webform you select, you input this information when you:

· Register an Account on our Services; or

· Fill out a Parent/Guardian Questionnaire; or

· Fill out a Contact Us Form.

· To match you with a Caregiver and provide the Services requested by you.

· To communicate with you about the Services you have requested.

· To provide you with customer support.

· To analyze your use of the Services, identify usage trends, determine the effectiveness of our promotional campaigns and to evaluate, personalize, and improve our Services, products, services, marketing efforts and your experience.

· To send communications about similar products and services, where appropriate, with the option to opt out at any time.

· To comply with applicable legal or regulatory requirements and law enforcement requests.

· To comply with and enforce our Terms of Service.

Caregiver Information:

· Full name

· Email address

· Location information (i.e., city/county)

· Professional background and history details.

· Caregiver needs/expectations

· Availability.

· Background check information (e.g., Social Security Number, government identification card, driver’s license details, professional work history, criminal history)

· Any other Personal Information you choose to share within the body of a webform.

Depending on the webform you select, you input this information when you:

· Register for an Account on our Services; or

· Fill out a Caregiver Survey.

· Fill out a Contact Us Form.

· To match you with a Client and provide the Services requested by you.

· To verify your identity and perform a background check.

· To communicate with you about the Services you have requested.

· To provide you with customer support.

· To analyze your use of the Services, identify usage trends, determine the effectiveness of our promotional campaigns and to evaluate and to personalize and improve our Services, products, services, marketing efforts and your experience.

We do not collect Personal Health Information subject to HIPAA.

Eczema Group Hug is not a “Covered Entity” nor do we perform certain functions or activities that involve the use or disclosure of protected health information on behalf of, or provides services to, a “Covered Entity” as defined in the Health Insurance Portability and Accountability Act of 1996 and its related regulations set forth in Parts 160, 162, and 164 of Title 45 of the Code of Federal Regulations (collectively, “HIPAA”). We do not purposefully collect or store “protected health information”, as defined in HIPAA.

As you navigate through and interact with our Website, we, and our third-party service providers, including analytics and third-party content providers, may automatically collect certain information from you whenever you access or interact with the Services.

Usage Information: Details of your visits to our Website, including which links you clicked on, content response times, logs, and other similar communication data and statistics about your interactions.

Device Information: Information about your computer and internet connection, including your Internet Protocol address, operating system, and browser type.

To investigate fraud and enforce our Terms of Service. To stop any activity that we may consider to be fraudulent, unethical or a legally actionable, or an activity posing a risk of being, illegal. Also, to protect the property rights of Eczema Group Hug or a third party, and to protect the safety of the public or any person.

Geolocation Information: Geolocation (latitude and longitude) collected through your Wi-Fi connections.

To provide, analyze and improve our Services. The collection of your geolocation may occur in the background even when you aren’t using the services if the permission you gave us expressly permits such collection. If you decline permission for us to collect your geolocation, we will not collect it.

Eczema Group Hug and its partners use cookies or similar technologies, which store certain information on your computer and allows us to, among other things, analyze trends, administer the Website, and to gather demographic information about our user base. The technology used to collect information automatically from Eczema Group Hug users may include the following:

● Cookies: Like many websites, we and our operational partners, analytics, and service providers use “cookies” to collect information. A cookie is a small data file that we transfer to your computer’s hard disk for record-keeping purposes. We use both persistent cookies that remain on your computer or similar device, and session ID cookies, which expire at the end of your browser session. We also use cookies to enhance the reliability, security and performance of our Website, including cookies that are passed by our Web Application Firewall.

● Embedded Scripts: An Embedded Script is programming code that is designed to collect information about your interactions with the Services, such as the links you click on. The code is temporarily downloaded onto your computer or other device and is deactivated or deleted when you disconnect from the Services.

Third-Party Cookies

· Eczema Group Hug uses third-party vendor tracking cookies, pixels, and other technologies to collect data about your activities when you visit our Website, the website of entities for which we serve advertisements, or the websites and online services where we display advertisements. This information may include the content you view, the date and time that you view this content, the products you purchase, or your location information associated with your IP address. Personal Information Provided by Third Parties

Caregiver Background Check

In order to promote the safety and integrity of the Services, you authorize Eczema Group Hug, as provided in the Terms of Service, to utilize third party verification service providers and sources to check Caregivers’ information on an ongoing basis against a variety of sources, which may include, but are not limited to, Motor Vehicles Records, Nationwide Criminal Database, Department of Justice (DOJ) National Sex Offender Registry, County Criminal Records, certain media streams, terrorist watch lists, criminal and fugitive watch lists, fraud watch lists, law enforcement reports, and other data to assist us in verifying the information you provide us (such as your name, address, email address, etc.) and the representations and warranties you make in the Terms of Service and on the Website (such as representations regarding your criminal background) (“Background Check”). The results of any Background Check will be made available to Eczema Group Hug.

If a Caregiver authorizes a Background Check, the results will be accessible to Eczema Group Hug and to any Client who requested the check. The third-party provider conducting the Background Check may also send the results directly to the Caregiver by email.

You acknowledge that sensitive material may be included in your Background Check, and that you are responsible for providing us and our Background Check service provider with correct information.

Third-Party Services

When you connect with us through a third-party platform we may, depending on your privacy settings, receive some information from your third-party account, and what we collect depends on your privacy settings with that service.

You may register to join the Services directly via the Website or by logging into your account with a third-party service (“TPS”) via our Service (e.g., Facebook, Google, Apple, and other third-party services that let you sign in using your existing credentials with those services). If you choose to register via a TPS, or to later link your account with the Services to your account with an TPS, we will use the Personal Information you have provided to the TPS (such as your name, email address, and other information you make available via the TPS) to create your account. Note that the information we collect from and through a TPS may depend on the privacy settings you have set with the TPS and the permissions you grant to us in connection with linking your account with the Services to your account with an TPS. Other than what we may share with the TPS as described below, the Personal Information a TPS has about you is obtained by the TPS independent of our Services, and Eczema Group Hug is not responsible for it.

Do Not Track Signal

Do Not Track (DNT) is a privacy preference that users can set in some web browsers, allowing users to opt out of tracking by websites and online services. We do not honor browser requests not to be tracked online (known as “Do Not Track”), but our cookie information above describes how you can opt out of receiving cookies.

HOW WE DISCLOSE AND SHARE YOUR INFORMATION

We may share information we receive about you as follows or as otherwise described in this Privacy Notice. When we disclose Personal Information, the recipient is required to keep that Personal Information confidential, secure and process the Personal Information only for the specific purpose for which they are engaged:

● With other Users of the Services: We match Clients with experienced Caregivers based on each Client’s location and unique needs.As a part of this process, we will share selected Caregiver profiles and locations with applicable Clients and the information of those Clients with selected Caregivers for the purposes of providing the Services. If a Client requests a Background Check on a Caregiver, the results of any Background Check will be disclosed solely to the Client who initiated the request for that specific Caregiver.

● Service Providers: We employ third party companies and individuals to provide Services on our behalf, to perform Services-related operations such as website maintenance database management, Background Checks, web analytics, payment processing, fraud detection or email marketing.

● Corporate Transactions: We may sell, transfer, or otherwise share some or all of our assets, including your Personal Information, in connection with a merger, acquisition, reorganization or sale of assets (including, in each case, as part of the due-diligence process with any potential acquiring entity) or in the event of bankruptcy.

● If Required by Law: We will share Personal Information with government agencies as required by law in response to lawful requests by public authorities, including to meet national security or law enforcement requirements. We may disclose any information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate: (i) to enforce our Terms and Conditions; (ii) to respond to claims, legal process (including subpoenas); (iii) to protect our property, rights, and safety and the property, rights, and safety of a third-party, our users, or the public in general; (iv) to stop any activity that we consider illegal, unethical or legally actionable activity; and (v) as required in accordance with applicable local, state, or federal laws.

● With your consent: We may disclose your Personal Information with your consent. For example, if you consent to a Background Check, we will disclose your Personal Information to our service providers to perform the Background Check.

YOUR CHOICES REGARDING YOUR INFORMATION

You have several ways to exercise control over your information:

● Account Settings: Registered Users may access, update or delete their personal information by accessing the applicable feature in their Account settings.Registered Eczema Group Hug Users may also update their choices regarding the types of communications they receive from us through the online Account settings.

● E-Mail: You may opt-out of receiving marketing emails from us by following the opt-out instructions provided in those emails. Please note that we reserve the right to send you certain communications relating to your Account or use of the Services (for example, administrative and service announcements) via email and other means and these transactional account messages may be unaffected if you opt-out from receiving marketing communications.

● Providing Consent:You maychoose whether to receive from us offers and promotions for: our products and services, the products or services of third parties, or products and services that we think may be of interest to you, by providing your consent (for example, by clicking an unticked checkbox).

YOUR RIGHTS REGARDING YOUR INFORMATION

Residents of certain jurisdictions may access, correct, update or delete your personal information; object to our processing of this information, ask us to restrict our processing of your personal information, or request portability of your personal information. Upon request Eczema Group Hug will provide you with information about whether we hold any of your Personal Information. You are responsible for maintaining the accuracy of the information you submit to us, such as your contact information. You may access, correct, or request deletion of your Personal Information by making updates to that information in your Account settings or by contacting Eczema Group Hug. If you request to access all Personal Information you’ve submitted, we will respond to your request to access within the time period required by applicable law.

We will use commercially reasonable efforts to honor your requests for deletion; however, certain residual information may actively persist on the Services even if you close your account. In addition, the rights described above may be limited, for example, if fulfilling your request would reveal Personal Information about another person, or if you ask us to delete information we are required by law to keep or have compelling legitimate interests in keeping (such as for fraud prevention purposes). Your Personal Information may remain in our archives and information you update or delete, or information within a closed account, may persist internally for our administrative purposes, to the extent permitted by law.

Please note that our Services require a minimum amount of Personal Information in order to function. Individuals who do not provide Personal Information (e.g., by not filling out a profile) may not be able to access the full functionality of features found on the Services.

Please note that we may require you to verify your credentials, by matching your e-mail address, or other account information to the information in our systems, before you can submit a request to exercise any of these rights. If you authorize another person to act as your agent to submit requests on your behalf, then unless you provide the agent with power of attorney under the California Probate Code, we will ask the agent to provide us the written and signed authorization that you provided to the agent, we will confirm with you that you did provide the authorization, and we will verify your identity.

Washington My Health My Data Act

If and to the extent that the Washington My Health My Data Act (“MHMD”) applies to Personal Information collected through the Services, Eczema Group Hug provides a My Health My Data Act Notice (“MHMD Notice”), hereby incorporated into this Privacy Notice by reference, for residents of the State of Washington in accordance with the My Health My Data Act of 2023 and sets out how Eczema Group Hug collects, uses and discloses Consumer Health Data (as defined in the MHMD) that we collect from you when you use our Services. INTERNATIONAL JURISDICTIONS

Our Services are hosted and offered in the United States of America (US), and are subject to US federal, state, and local law. If you are accessing the Services from another country, please be advised that you may be transferring your Personal Information to us in the US, and you consent to that transfer, processing, and storage of your Personal Information in accordance with this Privacy Notice. You also agree to abide by the applicable laws of applicable US federal, state, and local laws concerning your use of the Services and your agreements with us. Any persons accessing our Services from any jurisdiction with laws or regulations governing the use of the Internet, including the collection, use, or disclosure of personal information, different from those of the jurisdictions mentioned above may only use the Services in a manner lawful in their jurisdiction.
